XtremeUSB chip heat when idle

I have this chip in a USB audio device. When the device is powered up I noticed that the external area where this chip is located was hot.  The device was not in use.  When I opened the device there was a heat sink on this chip, the heat sink has a gray material, like a tape, stuck on it and there was some thermal paste on the chip. The heat sink and gray tape was loosely attached. I'm going to take some temp readings and see if there's any temp difference when I connect this device to the pc with a usb cable.  I'm going to look more closely at the power supply.
